PLEASE READ THIS TERMS OF USE AGREEMENT CAREFULLY. These Terms of Use (the "Terms") govern your use of t·AI·pset, a typesetting platform operated by The Word for the World ("TWFTW," "we," "us," or "our"), including our website at taipset.twftw.net (the "Site") and the software, tools, and online services made available through it (together with the Site, the "Services"). The Services allow Registered Users (as defined in Section 2.1) to upload manuscripts and source files, typeset them into print-ready and digital editions, and collaborate with others on publishing projects.
BY ACCESSING OR USING THE SITE OR THE SERVICES IN ANY WAY, REGISTERING FOR AN ACCOUNT, OR CLICKING "I ACCEPT" (OR A SIMILAR BUTTON), YOU CONFIRM THAT (1) YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS; (2) YOU ARE OLD ENOUGH TO ENTER INTO A BINDING CONTRACT WITH TWFTW; AND (3) IF YOU ARE ACTING FOR AN ORGANIZATION, YOU HAVE AUTHORITY TO BIND THAT ORGANIZATION TO THESE TERMS. "YOU" MEANS THE INDIVIDUAL OR ORGANIZATION IDENTIFIED AS THE USER WHEN THE ACCOUNT WAS REGISTERED. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SITE OR THE SERVICES.
THE SERVICES ARE CURRENTLY PROVIDED FREE OF CHARGE. HOWEVER, TWFTW RESERVES THE RIGHT TO MAKE THE SERVICES, IN WHOLE OR IN PART, CHARGEABLE AT A LATER DATE, AS DESCRIBED IN SECTION 1.2 (FREE SERVICE AND RIGHT TO CHARGE). YOU WILL NEVER BE CHARGED UNLESS YOU HAVE FIRST BEEN NOTIFIED AND HAVE EXPRESSLY AGREED TO PAY.
Some features of the Services may be subject to additional terms ("Supplemental Terms"), which will either be referred to in these Terms or shown to you when you first use that feature. If Supplemental Terms conflict with these Terms, the Supplemental Terms control for that feature only. These Terms and any Supplemental Terms together form the "Agreement."
WE MAY CHANGE THIS AGREEMENT FROM TIME TO TIME. When we do, we will post the updated Terms on the Site and change the "Effective Date" above. For significant changes, we will also notify Registered Users by email or within the Services. If you do not agree with a change, you should stop using the Services. Otherwise, your continued use of the Services means you accept the change.
1Use of the Services
The Site, the Services, and the software, templates, and materials we make available through them are owned by TWFTW and its licensors.
1.1 License to the Services. As long as you comply with this Agreement, TWFTW grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services, as they are designed to function, for your personal use or for the internal purposes of your organisation. Where the Services allow it, you may share projects with other Registered Users and work on them together ("Collaborate").
1.2 Free Service and Right to Charge. The Services are currently offered free of charge. TWFTW reserves the right to make the Services, in whole or in part, chargeable at a later date. This includes the right to charge for access to the Services, to introduce paid plans or paid features, and to change which features remain free. If TWFTW decides to make the Services chargeable:
- we will give Registered Users at least thirty (30) days' notice by email or within the Services before any fee takes effect
- you will not be charged anything unless you expressly agree to the fees and provide payment details
- the fees, billing, renewal, cancellation, and refund terms will be set out in Supplemental Terms that you will be asked to accept
- if you choose not to pay, you may continue to use any features that remain free, or close your Account and export Your Content before the change takes effect
The introduction of fees will not give TWFTW any greater rights in Your Content than those described in this Agreement.
1.3 Usage Limits. To keep the Services available to everyone, we may set reasonable limits on usage, such as the number of projects, pages processed, or file sizes, and may change those limits over time.
1.4 Beta Features. We may invite you to try early, experimental, or preview features ("Beta Features"). Beta Features are still in development, may change or be withdrawn at any time, and are used at your own risk. If you use Beta Features, we may ask for your feedback on how they perform.
1.5 Typeset Output. The Services automate typesetting tasks such as applying styles, breaking lines and pages, hyphenating words, and placing notes and figures. Automated typesetting can omit, duplicate, reorder, or mis-format text. Files produced by the Services ("Output") are provided as working drafts, and you are responsible for proofreading and approving all Output before you print, publish, or distribute it.
1.6 Updates. The Services will change over time. We may update, modify, or discontinue any part of the Services, with or without notice. You may need to update your browser or other software to keep using the Services.
1.7 Restrictions. The rights granted to you in this Agreement are subject to the following. You may not: (a) sell, rent, lease, sublicense, or otherwise commercially exploit the Services themselves, or offer them as a hosted service to others; (b) copy, modify, translate, or create derivative works of the Services, except your own Output; (c) decompile, disassemble, or reverse engineer any part of the Services, except to the extent applicable law expressly allows; (d) use bots, scrapers, crawlers, or other automated means to access or extract data from the Services, except through tools we provide for that purpose; (e) use TWFTW's or t·AI·pset's names or logos in metatags, hidden text, or in any way that suggests our endorsement without written permission; or (f) remove or obscure any copyright or other proprietary notice. Any unauthorised use ends the license granted in this Section.
1.8 Communications from the tool. By using the Services, you agree that we may send you messages about your Account and the Services, such as security alerts, service notices, and responses to support requests. If we send you newsletters or announcements about new features, you can unsubscribe at any time using the link in the message. You cannot opt out of essential service messages while you have an Account.
2Registration
2.1 Registering Your Account. Some features require you to register for an account (an "Account"). A person or organisation that has registered an Account is a "Registered User."
2.2 Signing In Through a Third-Party Service. We may let you sign in using an account you hold with another service, such as Google or Microsoft (a "Third-Party Account"). If you do, you allow us to receive the basic profile information that service shares with us, as permitted by your settings there. Your relationship with that third-party service is governed only by your agreement with it, and we are not responsible for its practices.
2.3 Registration Data. When you register, you agree to give us true, accurate, and complete information, and to keep it up to date. You confirm that you are at least eighteen (18) years old, or the age of majority where you live, and that you are not barred from using the Services under any applicable law. You are responsible for everything that happens under your Account. Do not share your password with anyone, and tell us immediately at taipset@twftw.org if you suspect unauthorised use. We may suspend or close an Account if information provided is false or incomplete, or if the Account was created after a previous Account was removed for violating this Agreement.
2.4 Equipment. You are responsible for the devices, software, and internet connection you need to use the Services, and for any charges from your internet or mobile provider.
3Responsibility for Content
3.1 Types of Content. "Content" means any text, markup, data, images, fonts, files, or other material made available through the Services. Content that you upload, submit, or otherwise make available through the Services, and the Output generated from it, is "Your Content." You, and not TWFTW, are responsible for Your Content, and other users are likewise responsible for the Content they make available ("User Content").
3.2 No Obligation to Pre-Screen. We do not review Content before it is uploaded and have no obligation to do so. We may, however, remove or restrict access to Content that we reasonably believe violates this Agreement or the law.
4Ownership
4.1 The Services. Apart from Your Content and User Content, TWFTW and its licensors own all rights in the Services, including the software, code, templates, design, documentation, and other materials that make up the Services.
4.2 Trademarks. "The Word for the World," "TWFTW," "t·AI·pset," and related logos are trademarks of TWFTW and may not be used without our permission. Other names and marks that appear in the Services belong to their respective owners.
4.3 Your Content. TWFTW does not claim ownership of Your Content, including your manuscripts and your Output. By uploading Your Content, you confirm that you own it or have all the rights needed to use it with the Services and to grant the license in Section 4.4. This includes the rights to any copyrighted texts (such as licensed Scripture translations), images, and fonts, and permission to embed those fonts in your Output where the font license requires it.
4.4 License to Your Content. You grant TWFTW a worldwide, royalty-free, non-exclusive license to host, store, copy, process, transmit, and display Your Content only as needed to provide and support the Services for you, keep the Services secure, fix problems, and comply with the law. You also grant the Registered Users you choose to Collaborate with the right to view, edit, and use Your Content as allowed by your project settings. This license ends when Your Content is deleted from the Services, except for copies held for a limited time in backups or as required by law.
4.5 No Use of Your Content for Other Purposes. We will not sell Your Content, publish it, or share it with anyone outside your account or organisation unless you choose to share it, except as described in our Privacy Policy or required by law.
4.6 Feedback. If you send us ideas, suggestions, or comments about the Services ("Feedback"), you agree that we may use them freely to improve the Services, without any obligation to you.
4.7 Service Analytics. We may collect and analyse information about how the Services are used, such as which features and layout settings are chosen most often, to maintain and improve the Services. We use this information only in aggregated or de-identified form that does not include the text of Your Content.
5User Conduct
You agree not to use the Services for any purpose that is unlawful or prohibited by this Agreement. You will not, and will not allow anyone else to, take any action or make available any Content through the Services that:
- infringes any copyright, trademark, or other right of any person or organisation, including by typesetting or distributing copyrighted works or licensed fonts without permission
- is unlawful, defamatory, fraudulent, harassing, hateful, obscene, or that exploits or endangers minors
- impersonates any person or organisation, or misrepresents your affiliation with them
- contains viruses, malicious code, or files designed to damage or disrupt the Services or other users' devices
- attempts to gain unauthorised access to the Services, other users' Accounts, or projects you have not been invited to
- interferes with the proper working of the Services, including by overloading them or getting around usage limits or security features
6Monitoring and Enforcement
We do not routinely monitor Content or user activity, but we may do so where reasonably necessary. If we believe that Content or conduct violates this Agreement, infringes someone's rights, threatens anyone's safety, or could create legal liability for TWFTW, we may: (a) remove or restrict access to the Content; (b) suspend or close the Account involved; (c) share relevant information with a person who credibly claims that Content infringes their rights, where the law allows; and (d) report illegal activity to the appropriate authorities.
7Interactions with Other Users
7.1 Your Responsibility. You are responsible for your dealings with other users, including the people you collaborate with. Disagreements over shared projects (for example, who owns or controls a project) should be resolved between the parties involved. We may, but are not required to, help.
7.2 Content From Other Users. We do not control and are not responsible for User Content. You use and rely on User Content at your own risk.
8Third-Party Services
8.1 Links and Integrations. The Services may link to or connect with websites, apps, font libraries, or services run by others ("Third-Party Services"). We do not control Third-Party Services and are not responsible for them. Your use of them is governed by their own terms and privacy policies.
8.2 Exporting Your Content. If you use a feature that sends Your Content to a Third-Party Service (for example, saving a file to a cloud storage account), you authorize us to transfer it there. We are not responsible for how that Third-Party Service uses it.
9Indemnification
You agree to defend, indemnify, and hold harmless TWFTW and its trustees, officers, staff, volunteers, partners, and licensors (the "TWFTW Parties") from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of: (a) Your Content; (b) your use of the Services; (c) your breach of this Agreement; or (d) your violation of any law or of any third party's rights. This Section survives the end of this Agreement.
10Disclaimers of Warranties
10.1 As Is. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. THE TWFTW PARTIES DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
10.2 No Guarantee of Results. WITHOUT LIMITING SECTION 10.1, THE TWFTW PARTIES DO NOT PROMISE THAT: (a) THE SERVICES WILL MEET YOUR NEEDS; (b) THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (c) OUTPUT WILL BE ACCURATE, COMPLETE, PRINT-READY, OR ACCEPTED BY ANY PARTICULAR PRINTER, DISTRIBUTOR, OR PLATFORM; OR (d) BETA FEATURES WILL WORK AS EXPECTED OR CONTINUE TO BE OFFERED.
10.3 Your Backups. WE STRONGLY RECOMMEND THAT YOU KEEP YOUR OWN COPIES OF YOUR SOURCE FILES AND IMPORTANT OUTPUT. YOU ARE RESPONSIBLE FOR ANY LOSS THAT RESULTS FROM RELYING ON THE SERVICES AS YOUR ONLY COPY.
11Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TWFTW PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR GOODWILL, OR FOR THE COST OF REPRINTING, RECALLING, OR CORRECTING PUBLISHED MATERIAL, ARISING OUT OF OR RELATING TO THE SERVICES OR THIS AGREEMENT, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
12Copyright Complaints
We respect the rights of copyright holders and will close the Accounts of users who repeatedly infringe. If you believe that material on the Services infringes your copyright, please send a notice to taipset@twftw.org that includes: (a) your physical or electronic signature; (b) a description of the copyrighted work; (c) where the infringing material is located on the Services; (d) your contact details; (e) a statement that you believe in good faith that the use is not authorised; and (f) a statement that the information in your notice is accurate and that you are the owner, or are authorised to act for the owner, of the copyright.
13Term and Termination
13.1 Term. This Agreement starts when you first use the Services or accept these Terms, whichever is earlier, and continues for as long as you use the Services.
13.2 Termination by You. You may stop using the Services and close your Account at any time through your Account settings or by contacting us.
13.3 Termination by Us. We may suspend or close your Account, or stop providing all or part of the Services, if you breach this Agreement, if required by law, or if we discontinue the Services. Where reasonably possible, we will notify you in advance and give you a chance to export Your Content.
13.4 Effect of Termination. When your Account is closed, your right to use the Services ends, and Your Content may be deleted from our systems as described in our Privacy Policy. Sections that by their nature should continue (including ownership, indemnification, disclaimers, and limitation of liability) will survive.
13.5 No Re-Registration. If we close your Account for breach of this Agreement, you may not create a new Account without our permission.
14International Users
The Services may be accessed and used from different countries. Users are responsible for ensuring that their use of the Services complies with all applicable local laws and regulations.
15General Provisions
15.1 Electronic Communications. You agree to receive notices and agreements from us electronically, and agree that electronic communications satisfy any legal requirement that they be in writing.
15.2 Assignment. You may not transfer this Agreement or your rights under it without our written consent. We may transfer this Agreement to a successor organisation or as part of a reorganisation.
15.3 Force Majeure. We are not liable for delays or failures caused by events outside our reasonable control, such as natural disasters, war, civil unrest, government action, power or internet outages, or failures of our hosting providers.
15.4 Governing Law. This Agreement will be governed by and interpreted in accordance with the applicable laws and legal requirements relevant to the parties and the provision of the Service.
15.5 Notices. We may send notices to the email address on your Account, and a notice sent there is effective even if that address is no longer valid. You may send notices to us at the address in Section 16.
15.6 Waiver and Severability. If we do not enforce a provision of this Agreement, that is not a waiver of our right to do so later. If any provision is found unenforceable, it will be applied as closely as possible to its original intent, and the rest of the Agreement will remain in effect.
15.7 Export and Sanctions. You may not use the Services in violation of any export control or sanctions laws that apply to you or to us.
15.8 Entire Agreement. This Agreement, together with our Privacy Policy, constitutes the entire agreement regarding the Services and replaces any prior agreements relating to the same subject matter.
